According to the plaintiff's counsel:

Russell West and his wife, Cheryl, were involved in a motor vehicle collision with Vicki Piotrowski in March 2007. The incident occurred at the intersection of Highway C and 67th Street in Racine, Wis.

Cheryl West, 52, died at the scene. Her husband suffered fractures to his right ankle and arm, plus injuries to his right knee. His injuries were 55 percent permanent for his ankle, 15 percent permanent for his knee and 10 percent permanent for his wrist.

His medical expenses totaled $340,901.62, and he anticipated spending an additional $100,000.

West made a settlement demand of $2.4 million from Piotrowski and her liability insurer, American Family Insurance. Piotrowski made a counteroffer of $1.5 million.

In June 2009 the parties settled out of court for $1.5 million. The plaintiff's counsel, Timothy S. Trecek of Habush, Habush & Rottier, negotiated the settlement with American Family adjuster James Holtmann.
