Summary of Facts:
Johnnie Washington, an adult male pedestrian on property owned by defendant Harold Halberg and insured by defendant State Farm General Insurance Company, reportedly suffered a neck fracture requiring surgery as well as and headaches, when he allegedly slipped and fell on an accumulation of ice due to the deterioration of the roof and building structure of a parking garage adjacent to the sidewalk. The plaintiff contended that the defendant Halberg failed to exercise due care for the safety of frequenters and/or invitees, breached his duty of care, failed to warn, failed to properly maintain the premises, and violated the Safe Place Act.
