Peter Popp was walking along Lake Street when a vehicle operated by James Swentner attempted a turn into a parking lot and struck Popp. Popp allegedly sustained unspecified personal injuries as a reuslt of the incident.

Swentner was insured by American Family Mutual Insurance Company.

Popp filed a lawsuit against American Family, Swentner, and The Insurance Company of the State of Pennsylvania. The plaintiff alleged Swentner was negligent and careless in the operation of his vehicle. He sought compensation for his severe and permanent personal injuries.

The parties reached a settlement in the amount of $250,000.
