Summary of Facts:
Plaintiff Jeffrey Abb was reportedly driving his automobile westbound on U.S. Highway 8 in Barron, Wis., with his wife, plaintiff Cynthia Abb, as his passenger. The plaintiffs said that their automobile was struck by a vehicle operated by defendant El Houcine Ahizoune and insured by defendant Integrity Property & Casualty Insurance Company, when Ahizoune, who was also traveling on the highway, allegedly crossed the centerline with his vehicle.

Cynthia Abb reportedly suffered personal injuries due to the collision and the plaintiffs sustained property damage to their automobile.

In a complaint, the plaintiffs asserted that Ahizoune's negligent driving, which included failing to maintain proper control over his vehicle, failing to yield the right-of-way, driving at an excessive rate of speed and negligently crossing a highway centerline while traveling on a highway, caused the collision.

The plaintiffs sought damages for Cynthia's personal injuries, medical expenses, pain and suffering and disability, as well as damages for their automobile's property damage.

The plaintiffs further sought damages for Jeffrey's loss of consortium due his Cynthia's injuries caused by the accident.

The defendants denied liability and argued that Jeffrey's own negligent driving may have caused the collision.

The defendants also disputed the nature and extent of the plaintiffs' claimed injuries and damages.

Following a jury trial, jurors determined that Ahizoune's negligent driving caused the collision and Cynthia Abb's injuries and damages. The jury declined to find that any negligence on Jeffrey Abb's part had caused the accident.

Jurors awarded Cynthia Abb damages of $27,500, but declined to award Jeffrey Abb damages for his loss of consortium claim.
